Terms & Conditions LD Lines Frequent Traveller Scheme
1. Parties :
The Terms & Conditions of the LD Lines Frequent Traveller Scheme are concluded between :
- LD LINES, a private company, subject to French law, with its head office at 28, Quai Gallieni at Suresnes (92158) in France,
OR
- LD TRANSMANCHE FERRIES, a private company, subject to French law, with its head office at 7, quai Gaston Lalitte at Dieppe (76200) in France,
AND
- The Passenger which referred to an individual major (over 18) fulfilling the appropriate form in order to become a member of the Scheme. The LD Lines Frequent Traveller Scheme is not open to minors, travel agents, tour operators or their agents, any corporation. Please note nominated drivers must be individuals.
2. Definitions :
- Frequent Traveller means individuals (excluding businesses) who apply to join the LD Lines Frequent Traveller Scheme by completing the necessary registration process and who fulfil the conditions of subscription.
- LD Lines Frequent Traveller Scheme means loyalty program addressed to Passenger who wants to earn LD Miles and use them to book Qualified Trip with a Qualified Vehicle on LD Lines/LD Transmanche Ferries Routes.
- LD Miles means the credit accumulated by Frequent Travellers for each booking on the LD Lines / LD Transmanche Ferries Routes.
- Passenger includes the Purchaser of the Passage Contract and any person or persons named on the relevant passage ticket and who performs the crossing.
- Qualified Trip means motorist trip with one of the following Qualified Vehicle excluding foot passengers.
- Qualified Vehicle means cars, motorbikes, vans, motor homes, caravans and trailers (height up to 2.2m, length up to 8m). Vehicles exceeding these dimensions are carried at freight rates and do not qualify for the LD Lines Frequent Traveller Scheme.
- Routes means all the LD Lines or LD Transmanche Ferries ferry routes: Portsmouth Le Havre, Newhaven Dieppe, Dover Boulogne s/ Mer, Dover Dieppe, Rosslare Le Havre.
3. Generalities :
- Booking and Travel are subject to usual LD Lines or LD Transmanche Ferries Terms & Conditions.
- LD Lines/LD Transmanche Ferries reserves the right to amend conditions, rebate amounts or withdraw the membership or operation of the LD Lines Frequent Traveller Scheme at any time and without any causes and without explanation. LD Lines/LD Transmanche Ferries also reserves the right to withdraw any individual's membership of the LD Lines Frequent Traveller Scheme at any time.
4. Subscription :
- The Passenger acknowledges that he has read the Terms and Conditions of the LD Lines Frequent Traveller Scheme and he confirms his acceptance of these Terms and Conditions.
- To qualify for the LD Lines Frequent Traveller Scheme, individuals must have made at least 2 or more return motorist trips or 4 single motorist trips with Qualifying Vehicles on LD Lines/LD Transmanche Ferries Routes within the 6 months period preceding registration with the LD Lines Frequent Traveller Scheme.
- LD Lines/LD Transmanche Ferries reserves the right to review and accept or reject any application without providing for any explanation.
- A Passenger can only make one subscription to the LD Lines Frequent Traveller Scheme.
- The Frequent Traveller cannot transfer, alienate or devise his account and/or LD Miles.
- Members of any other LD Lines/LD Transmanche Ferries discount scheme, including clients owning Bulk Tickets, are not eligible for membership of the LD Lines Frequent Traveller Scheme. Discounts obtained from the LD Lines Frequent Traveller Scheme cannot be used in conjunction with any other discount schemes or offers.
- To open the account, the Frequent Traveller must connect on the following link : http://www.ldlines.com/frequent_traveller.php. From this latter, the Frequent Traveller must fill in completely the registration form on his own or from the computer available on board vessels of LD Lines / LD Transmanche Ferries.
5. Privacy :
- LD Lines/LD Transmanche Ferries requires personal information for the treatment and the use of the LD Lines Frequent Traveller Scheme. LD Lines/LD Transmanche Ferries can transfer such information to LD Lines/LD Transmanche Ferries but undertakes not to transfer such information to any third party.
- In accordance with the French Law on Information Technology and Civil Liberties, the Frequent Traveller has the right to oppose, to gain access to, to rectify, to modify and to delete the information about the Frequent Traveller (according to the articles 38 to 40 of the French Law on Information Technology and Civil Liberties of 6 January 1978). Such amendment must be done directly by the Frequent Traveller on his personal account, through its internet access to his personal account.
- The Frequent Traveller guarantees accuracy of the personal data given to LD Lines/LD Transmanche Ferries and will be liable to any wrong, incomplete or expired information.
6. Credits and Use :
6.1. LD Miles :
6.1.1. Credits :
- At the opening of the account :
- LD Lines/LD Transmanche Ferries will credit the new Frequent Traveller with 10% of its total expenditure for the last 6 months including expenditure on accommodation. Credit will be earned through LD Miles to be used for future LD Lines/LD Transmanche Ferries bookings.
- A LD Miles Card, named LD Lines Frequency, will be issued and sent to any new Frequent Traveller. Such card mentions the number of the Frequent Traveller account which has to be used for each booking in order to credit the account. The Card issued is personal to the Frequent Traveller and cannot be used by someone else.
- For a ticket booked through the LD Lines Frequent Traveller Scheme, a registration confirmation shall be sent to the Frequent Traveller. Registration process is complete only upon reception of the said confirmation.
- After completion of a single or return trip on LD Lines/LD Transmanche Ferries Routes following a registration, LD Lines/LD Transmanche Ferries will credit the new Frequent Traveller with LD Miles.
- For £10 spent for a ticket, the Frequent Traveller will get 100 LD miles.
- In anyway, the LD Miles cannot be converted into cash.
- For each booking, LD Miles will be credited on the account of the Frequent Traveller.
Eg: for £1000 tickets value including expenditure on accommodation, 10000 LD Miles are credited on your account, usable on the purchase of a return ticket.
- Amendments made on bookings using a frequent traveller number must be reported to frequenttraveller@ldlines.fr to be taken into account. Amendment fees (£10) will not be included into the recalculation of LD Miles.
- At the booking, if the Frequent Traveller forgot to mention his LD Miles Card number, he would be entitled to benefit of those non-credited LD Miles on his account by mailing the original boarding pass. Such request for retroactive credit has to be sent to the following address : LD Lines Le Havre - Terminal de la Citadelle, BP 90746, F-76060 LE HAVRE. In this case, a one month period is required to credit the Frequent Traveller account.
- On closing of the account :
- The LD Miles balance cannot be subject to any reimbursement or compensation of whatsoever nature. The LD Miles balance will be lost entirely and definitely.
- The LD Miles Card will be automatically cancelled.
6.1.2. Use :
- LD Miles can only be used against a return trip booking.
- To book a trip with LD Miles, the Frequent Traveller must connect on the following link : http://www.ldlines.com/frequent-traveller . From this latter, the Frequent Traveller must fill in completely the booking form on his own or from the computer available on board.
- Such booking has to be made from 30 days maximum to 7 days minimum prior to the planned departure and will be subject to availability.
- Tickets bought with LD Miles, valid on LD Lines/LD Transmanche Ferries Routes, are subject to limited availability according to day and time of departure. LD Lines/LD Transmanche Ferries cannot be held liable for lack of availability.
- A booking cannot be partially paid using LD Miles. As a matter of consequence, if the Frequent Traveller wants to use his credits, the booking has to be fully paid with LD Miles. Frequent Traveller must ensure his LD Miles account has enough credit prior to book a ticket.
- Once booking confirmation has been sent to the Frequent Traveller, the booking cannot be cancelled, amended or reimbursed for whatsoever reason.
- The Frequent Traveller must book at least one return ticket within 24 months from the registration of the last travel. If this condition is not fulfilled and at sole discretion of LD Lines/LD Transmanche Ferries, the account of the Frequent Traveller will be simply deleted.
- The LD Miles credited must be used within 36 months, otherwise they will be lost.
6.2. LD Lines Premium Member
- Frequent Traveller, who earned more than 12000 LD Miles in a year, will automatically get a new status as LD Lines Premium Member and a new card named LD Lines Premium Card. Such status and card will be issued from the date when the Frequent Traveller obtained more than 12000 LD Miles and be valid for a period of one year from the next calendar year. Subject to limited availability and according to day and time of departure, the LD Lines Premium Member will benefit to the following privileges:
- For each booking, the LD Lines Premium Member is entitled to a seat upgrade.
- Free Access to exclusive areas onboard, depending on the vessels.
7. Liability
- LD Lines/LD Transmanche Ferries cannot be held liable for any direct or indirect loss or damages due to the closing of account or to any amendment of the present Terms & Conditions.
- LD Lines/LD Transmanche Ferries reserves the right to carry out checks to ensure that there is no misuse of the Frequent Traveller Scheme. The Frequent Traveller must provide proof of identity at check-in and when requested by LD Lines/LD Transmanche Ferries staff. LD Lines/LD Transmanche Ferries cannot be held liable for a wrong calculation of the LD Miles.
- The fraud or the non respect of those Terms & Conditions by the Frequent Traveller allows LD Lines/LD Transmanche Ferries to close immediately the fraudulent account without any notice. Consequently, the Frequent Traveller will not be entitled to open a new LD Miles account. In such case, LD Lines/LD Transmanche Ferries reserves the right to claim for damages and all other expenses.
8. Miscellaneous
- Those Terms & Conditions are governed by and construed in accordance with the French law.
- All disputes arising out of or in connection with the LD Lines Frequent Traveller Scheme or those Terms & Conditions, which cannot be settled amicably, shall be submitted to the exclusive jurisdiction of the competent court in Paris.
- The Terms and Conditions of the LD Lines Frequent Traveller Scheme shall be severable and the invalidity of any provision shall not impair the validity of any other provision.
